Privacy Policy
Version 12/14/2004
Zoundry LLC ("Zoundry" or "we" or "us") uses this website to distribute information and operate its affiliate marketing service ("service") over the World Wide Web. The word "our" is a possessive pronoun referring to Zoundry. While certain areas of this website may be accessed and viewed by members of the general public, not all visitors to this website may use Zoundry's service. Eligible individuals and organizations must apply for membership and be approved by Zoundry in order to become a Zoundry member ("user.") Zoundry does not collect personally identifiable information from public visitors to this website and therefore does not have a general privacy policy for this website. Instead the following privacy policy applies specifically to Zoundry's users.
Zoundry respects your privacy and we have designed our software and service with the protection of your privacy as a key priority. This Privacy Policy outlines the types of personal information we collect when you use Zoundry's products and services, as well as some of the steps we take to protect it.
The following principles apply to the personally identifying information we ask for and that you provide. "Personally identifying information" is information that individually identifies you, such as your name, physical address or email address.
Information Collection
- Download of the Zoundry software does not require any personal information.
- The Zoundry service requires you to register for an account. Zoundry asks you for some personal information in order to create an account (typically your name, email address, web site/blog URL, and a password for your account) and we will use that information to provide the service and maintain records for you. In certain situations, we may ask for direct deposit routing information or tax identification, such as social security number, which we maintain in encrypted form on secure servers. When you register for an account with Zoundry, we will act as your master affiliate and record and receive commissions on your behalf, as well as manage activity reports for your links.
- Zoundry collects limited non-personally identifying information when you search for products using the Zoundry Product Placement Engine™ either through our software or service. This information includes your search terms and selected product(s). Zoundry may also monitor whether users click through your Zoundry affiliate links. We use this information to operate and improve our services. For example, we can improve the relevancy of our search results and inform you of the most popular products.
- Occasionally we will ask for personal information, such as email address, when you want to invite a person to join the Zoundry Service or refer a product to a friend. In these cases, we will use their email addresses only to send them information you requested (invitation or product URL and information) with any message you provide. We will not use their email addresses for any other purpose.
- Spam: Zoundry will terminate the account of any person that it believes, in its sole discretion, is using its service to send any spam or other unsolicited bulk email or to harass or otherwise send unwanted communications. In such cases, Zoundry shall have the right to an injunction and to seek monetary damages.
Information sharing
- We will not rent or sell your personally identifying information to other companies or individuals, unless we have your consent. However, we may share such information in the following situations: (a) We have your consent, (b) We provide such information to trusted parties for the sole purpose of processing personally identifying information for us. When this occurs, it is subject to agreements that require those parties to process such information only upon our instructions and subject to this Privacy Policy and appropriate confidentiality and security measures, and (c) We decide that we are required by law or have a reasonable belief that preservation or disclosure of such information is necessary to protect the rights, property, or safety of Zoundry, its users, or the public.
- If you have an account, we may share the information provided in your account with our third-party merchants in order to comply with the affiliate agreements we have signed with them. We will not disclose your account information to any other individuals or non-affiliated companies, except in the limited circumstances described in this Policy or with your consent.
- If you have installed and are using our software, we may use the information submitted under your account in our software in order to provide you with a seamless experience and to improve the quality of our service.
- In the event of a transfer of ownership of Zoundry LLC, such as through an acquisition or merger with another company, we will provide notice before any personally identifying information is transferred and becomes subject to a different privacy policy.
- We may share aggregated user information with others. Examples of this include the number of users who searched for or created links for a specific product.
- We may, but are not obligated to, retain the information we obtain about any user after that user leaves the Zoundry service.
Use of Cookies
- When you register or log into your account at Zoundry, a cookie is sent to your computer that uniquely identifies your browser. A "cookie" is a small file containing a string of characters that is sent to your computer when you visit a website. We use cookies to maintain your session with the Zoundry service. This cookie is discarded when you close your browser.
- If you have chosen the "Remember Me" option when logging into Zoundry service, Zoundry will place a persistent cookie on your computer to recognize you on your next visit to the Zoundry service. To use the "Remember Me" feature, you must enable cookies on your browser.
- Most browsers are initially set up to accept cookies. You can change your browser settings to refuse all cookies or to notify when a cookie is being sent. However, some Zoundry features or services may not function properly without cookies.
- Note: Zoundry leverages the affiliate tracking technology of its third-party merchants, most of which use non-personally identifying cookies to track click-throughs and qualifying purchases made through your Zoundry affiliate links. Any use of this information by a merchant or its third-party affiliate technology provider is governed by those parties' own privacy policies. If cookies are not enabled in your blog visitors' browsers, then you may not earn commissions on purchases made by those visitors.
Information security
- We take appropriate measures to protect against unauthorized access to or unauthorized access, alteration, or destruction of data.
- We restrict access to your personally identifying information to employees who need to know that information in order to operate, develop or improve our service.
Updating your information
- We provide a way you to update and correct your personally identifying information in your account. For more information, please see your Account page within the Zoundry service.
Changes to this policy
- Please note this Privacy Policy will change occasionally. While we expect most changes to be minor, there may be some changes that are more significant. Regardless, we will post any changes on this Privacy Policy page on our website and, if the changes are significant, we may also highlight in a more prominent manner. Each version will be noted by its date at the top of this page. Prior versions of this Privacy Policy will be kept in an archive for you to review at any time.
